1. Overview

This website is operated by Kalpita Sanket Achrekar, trading as Serendipity (“Serendipity”, “we”, “us” or “our”).

Throughout the website, the terms “you” and “your” refer to the person visiting the website or purchasing from us.

By visiting serendipitywears.com, creating an account or placing an order, you agree to these Terms of Service. These Terms apply alongside our Privacy Policy, Shipping Policy and Returns & Refunds Policy.

Please read these Terms carefully before using our website. If you do not agree to them, you should not use the website or purchase our products.

Nothing in these Terms affects your statutory rights as a consumer.

3. Eligibility

You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order through our website.

By placing an order, you confirm that:

  • The information you provide is accurate and complete.

  • You are authorised to use the selected payment method.

  • You are legally capable of entering into a binding contract.

You must not use our products or website for any unlawful or unauthorised purpose.

4. Products and print-on-demand production

Serendipity sells clothing, accessories and other merchandise featuring original typography, artwork and designs.

Many of our products are produced using a print-on-demand model. This means an item may be printed or prepared after your order is placed, rather than being held as ready-made stock.

Production may be carried out by carefully selected third-party fulfilment partners, including Printful or other production providers. These partners may print, pack and ship products directly to you on our behalf. Your purchase contract remains with Serendipity.

Print-on-demand production does not automatically remove any cancellation or return rights you have under applicable consumer law. Different rules may apply to products that are genuinely personalised or made to your individual specifications, where clearly stated before purchase.

5. Product information and appearance

We aim to describe and display every product as accurately as reasonably possible. However:

  • Colours may appear slightly different depending on your screen settings, device and lighting.

  • The size and positioning of a printed design may vary slightly between products or sizes.

  • Minor variations may occur through the printing and manufacturing process.

  • Lifestyle photographs and mock-ups are illustrative and may include props or backgrounds that are not included with the product.

These reasonable variations are not necessarily faults. However, this does not affect your rights if a product is faulty, damaged, materially different from its description or not of satisfactory quality.

Please review the relevant product description, size guide, colour options and care instructions before ordering.

6. Orders

When you place an order, you are making an offer to purchase the selected products.

After your order is submitted, you should receive an order-confirmation email. This confirms that we have received your order but does not necessarily mean that it has been accepted.

We may refuse or cancel an order before fulfilment where reasonably necessary, including if:

  • A product is unavailable.

  • Payment cannot be authorised.

  • The price or product information contains an obvious error.

  • We reasonably suspect fraud or unauthorised activity.

  • The delivery address cannot be serviced.

  • The order breaches these Terms or applicable law.

If we cancel an order after receiving payment, we will refund the amount paid for the cancelled item or order using the original payment method.

Once production has begun, it may not always be operationally possible to stop an order. This does not remove any cancellation rights available to you under applicable consumer law.

7. Order information and changes

You are responsible for checking that your product selection, size, colour, delivery address and contact information are correct before completing checkout.

If you notice an error after placing an order, contact us as soon as possible at serendipity141911@gmail.com. We will try to help, but we cannot guarantee that an order can be changed once production or fulfilment has begun.

We are not responsible for delays or failed delivery caused by incorrect or incomplete information supplied by you, although we will provide reasonable assistance where possible.

8. Prices and payment

Prices are displayed in the currency selected or shown at checkout.

The total price payable, including applicable taxes and delivery charges, will be displayed before you complete your purchase.

We reserve the right to change product prices at any time. A price change will not affect an order that has already been accepted, except where there is an obvious pricing error.

Payments are processed through Shopify and the payment providers offered at checkout. We do not directly store your complete payment-card details.

You agree to provide current, complete and accurate billing and payment information.

9. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions communicated with the relevant offer.

Unless stated otherwise:

  • Discount codes cannot be exchanged for cash.

  • Only one discount code may be used per order.

  • Discount codes cannot be applied retrospectively.

  • Offers may be limited by date, product, location or availability.

  • Discounts do not normally apply to delivery charges.

We may withdraw or correct a promotion where it has been published in error, subject to applicable consumer law.

10. Delivery

Production and delivery estimates are provided on our website, product pages, checkout or Shipping Policy.

Delivery dates are estimates unless we expressly agree to a guaranteed date. Production time and shipping time are separate, and delays may occasionally occur due to carriers, customs, weather, public holidays or circumstances outside our reasonable control.

We will fulfil orders within the time agreed with you or, where no different timeframe has been agreed, within the period required by applicable consumer law.

Please refer to our Shipping Policy for further information about estimated delivery times, tracking and delayed or missing parcels.

11. International orders, customs and import charges

Orders delivered outside the United Kingdom may be subject to customs duties, import taxes or handling charges imposed by the destination country.

Where these charges are not collected at checkout, you may be responsible for paying them. We do not control these charges, and their amount varies by country.

You are responsible for ensuring that the products you order may lawfully be imported into the delivery country.

Any unavoidable customs-related charges or restrictions will be handled in accordance with applicable consumer law.

12. Cancellations, returns and refunds

Your cancellation, return and refund rights are explained in our Returns & Refunds Policy, which forms part of these Terms.

For most goods purchased online, UK consumers normally have a legal right to cancel within 14 days after receiving the goods. Certain exceptions may apply, including goods made to the customer’s specifications or clearly personalised.

A standard Serendipity product is not treated as personalised solely because it is produced after an order is placed.

Your statutory rights concerning faulty, damaged, misdescribed or unsatisfactory goods remain unaffected. Nothing in these Terms or our Returns & Refunds Policy excludes those rights.

13. Faulty, damaged or incorrect products

If your product arrives faulty, damaged, incorrectly printed or different from what you ordered, contact us promptly at serendipity141911@gmail.com.

Please include:

  • Your order number.

  • A description of the problem.

  • Clear photographs showing the product and issue.

  • A photograph of the packaging or shipping label where relevant.

Photographs help us assess the issue and communicate with our fulfilment provider. Requesting evidence does not reduce your statutory rights.

Depending on the circumstances and your legal rights, an appropriate remedy may include repair, replacement, price reduction or refund.

14. Care and use of products

Please follow the care instructions supplied with or displayed for each product.

We are not responsible for damage caused by misuse, accidental damage, normal wear and tear, failure to follow care instructions or alterations made after delivery.

This does not affect your rights where a product was faulty or not of satisfactory quality when supplied.

15. Intellectual property

Unless otherwise stated, the website and its content—including Serendipity designs, illustrations, typography, product names, photographs, graphics, logos, text and branding—belong to or are licensed to Serendipity and are protected by intellectual-property laws.

You may view and use the website for personal, non-commercial shopping purposes.

Without our prior written permission, you must not:

  • Copy, reproduce or republish our designs or website content.

  • Use our artwork to manufacture or sell products.

  • Modify, trace or create substantially copied versions of our designs.

  • Remove copyright, trademark or ownership notices.

  • Use our content for commercial purposes.

  • Scrape, harvest or systematically extract website content or data.

Purchasing a product does not transfer ownership of the intellectual property printed or displayed on that product.

16. Reviews and customer content

If you submit a review, photograph, comment or other content to us, you confirm that:

  • The content is your own or you have permission to share it.

  • It is honest and not misleading.

  • It does not infringe another person’s rights.

  • It is not unlawful, abusive, discriminatory or malicious.

  • It does not contain harmful software, spam or confidential information.

You retain ownership of your content. Where you submit content for publication or promotional use, you grant Serendipity a non-exclusive, worldwide, royalty-free licence to display, reproduce and share that content in connection with our website, products and marketing.

We will ask for permission before using a customer’s image in advertising where appropriate. You may contact us if you want us to stop using your submitted content, although removal may not always be possible where content has already appeared in completed physical materials.

We may moderate or remove content where reasonably necessary.

17. Acceptable use

You must not:

  • Use the website for fraudulent or unlawful activity.

  • Attempt to gain unauthorised access to the website or another user’s account.

  • Introduce viruses, malicious code or other harmful technology.

  • Interfere with the website’s operation or security.

  • Collect information about other users without permission.

  • Place fraudulent orders or misuse discounts.

  • Use automated systems to scrape, copy or overload the website.

  • Impersonate another person or provide false information.

We may suspend or restrict access where we reasonably believe these Terms have been breached.

18. Accounts

If you create an account, you are responsible for keeping your login information secure and for activity conducted through your account.

Please notify us promptly if you believe your account has been accessed without authorisation.

We may suspend or close an account where reasonably necessary to protect customers, prevent fraud, comply with the law or address a serious breach of these Terms.

19. Third-party services and links

Our store is hosted by Shopify. We also use third-party providers for services such as payment processing, printing, fulfilment, delivery and website functionality.

Our website may contain links to independent third-party websites. We are not responsible for the content, availability, privacy practices or terms of websites that we do not operate.

Your use of a third-party service may be governed by that provider’s own terms and privacy policy.

Nothing in this section reduces Serendipity’s responsibilities to you as the seller of products purchased from our store.

20. Website availability

We aim to keep the website accurate, secure and available. However, we cannot guarantee that it will always operate without interruption, delay or error.

We may temporarily suspend, update or modify parts of the website for maintenance, security or operational reasons.

We are not responsible for losses caused by events outside our reasonable control, except where responsibility cannot legally be excluded.

21. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

  • Death or personal injury caused by negligence.

  • Fraud or fraudulent misrepresentation.

  • Breach of rights that cannot legally be excluded.

  • Faulty or misdescribed goods where statutory remedies apply.

If you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a purchase made wholly or mainly for business purposes.

22. Events outside our reasonable control

We will not be responsible for delay or failure caused by circumstances outside our reasonable control, such as severe weather, carrier disruption, industrial action, customs delays, natural disasters, public-health emergencies, internet outages or disruption affecting production partners.

If such an event materially affects your order, we will contact you where reasonably possible and take appropriate steps. Your statutory rights, including any applicable right to cancel, remain unaffected.

23. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

By using the website, you acknowledge that your information may be processed by service providers involved in operating the store and fulfilling orders, subject to appropriate data-protection requirements.

24. Changes to these Terms

We may update these Terms occasionally to reflect changes to our business, website, services or applicable law.

The version that applies to your purchase will generally be the version available when you place your order. Changes will not retrospectively reduce rights connected with an already accepted order.

The latest version will be published on this page with its updated date.

25. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

26. No waiver

If we delay or choose not to enforce a right under these Terms, that does not mean we have waived that right.

27. Governing law and disputes

These Terms and any contract between you and Serendipity are governed by the laws of England and Wales.

If you live elsewhere in the United Kingdom or another country, you may also benefit from mandatory consumer protections provided by the laws of your place of residence.

We encourage you to contact us first so that we can try to resolve any concern fairly and promptly.

Nothing in these Terms prevents you from using any dispute-resolution process or court available to you under applicable consumer law.

Paste this into Shopify Admin → Settings → Policies → Terms of Service, then save it. Shopify should automatically make it available during checkout. Also ensure the Terms link appears in your website footer.

This version correctly preserves the 14-day cancellation right for your standard designs. We should therefore check the Returns Policy created earlier and remove any statement saying that all Printful products are exempt merely because they are made to order. UK distance-selling requirements and UK returns guidance.
